Our Privacy Policy

This Privacy Policy sets out how Vizionality LLC ("Vizionality," "we," "us," or "our") looks after personal information in connection with the KitchenKreate mobile application and our website (together, the "Service"). It explains the kinds of personal information that we collect and why we collect it. It also describes how we hold, use, and disclose personal information.

By registering as a user for, or using, the Service, or by providing personal information to us including through a registration process, you agree to the terms of this Privacy Policy. If you do not agree to this Privacy Policy, please do not use the Service.

When you agree to the terms of this Privacy Policy, you consent to the collection, use, storage, and disclosure of your personal information as described here.

The personal information we collect

We collect personal information in the provision of our products and services, including the marketing of our products and services, so that we can provide products, services, and information to our customers and potential customers. We also collect information where we are required to do so by law.

KitchenKreate is rated 4+ on the App Store and is intended for a general audience. It is not directed to children, and we do not knowingly collect information from, or direct any of our content specifically to, children under the age of 13. If you are under 13 years of age, please do not provide your personal information to us.

The types of personal information we collect depend on the circumstances in which the information is collected, and may include:

• Your name and contact details, including email, address, mailing address, and mobile number
• Information regarding your use of or interest in our products and services
• Records of communications and dealings with you, such as emails, text, SMS, chat, telephone, and in-person communications
• Information regarding your use of the Service
• Authentication data, including your username and password when you log in via the Service
• Profile information if you set up an account with us, including any information you add to a profile you create through the Service, such as photos and information about yourself
• Information you voluntarily provide about yourself, such as food preferences, lifestyle choices, cuisine choices, nutritional goals and preferences, dietary information, and grocery shopping patterns
• The recipes, meal plans, shopping lists, and favorites you create, edit, or save in the Service
• Your device's geo-location when accessing the Service
• Advertising data, such as your preferences in receiving marketing materials from us and third parties, and your communication preferences
• Data related to groceries or food, such as information relating to any products that you select from a shopping list for purchase from a third-party site
• Information we may collect as part of a survey, customer feedback request, or a competition
• Information that you provide to us, for example for verification purposes or as evidence in respect of a complaint
• Other information that you provide to us during the course of business

We also collect information about people who are our suppliers and business partners, or who are employed by them — namely, the information we need to do business with that party. When you communicate with us, we may collect additional information, including how best to manage communications with you.

You have no obligation to provide information to us, but if you do not provide certain information, you may not be able to use the Service.

How recipe generation works

When you submit a video link (for example, from YouTube, TikTok, or Instagram), a recipe website URL, or a photo of a printed or handwritten recipe, that content — and, for videos, information the App extracts such as on-screen text — is processed to draft a structured recipe. This processing is performed using Anthropic as our artificial intelligence provider, acting on our behalf and instructed to use the content only to perform the recipe-generation service. We do not retain the inputs or outputs of this AI processing, except that we may retain limited information you provide — such as any allergies or dietary restrictions — so we can remember your preferences and tailor future recipes for you.

Online services and usage data

When you use our Service, it may automatically collect information about you and how you use it. We may also collect information that your browser or device sends whenever you access the Service. This may include:

• Usernames and passwords that you create to access the Service
• Which functions and features you use and how you use them
• Which pages you visit on our website
• Device information, such as the model and ID of the device you use, operating system, telephone number, and mobile phone network
• Server log information, such as details of how you used the Service, IP address, hardware settings, browser type, browser language, the date and time of your use, and referral URL
• Information that may uniquely identify your browser or your account
• Location information
• Information relating to your visits to other websites where we have a relationship with the other website
• Shopping lists you create and recipe interactions within the Service

If you visit our website, we may collect information on your use of it, such as pages visited, links clicked, text entered, and mouse or cursor movements, as well as the referring URL, browser, device, operating system, and Internet Protocol ("IP") address. We may use publicly available sources to approximate your geographic region and Internet Service Provider based on your IP address.

We may use your IP address or domain name for internal traffic monitoring and capacity management, or to otherwise administer the Service. Where used for these purposes, patterns and usage are tracked on an aggregate or statistical basis to improve our service and content.

We may use various technologies to collect and store information, including cookies, pixel tags, local storage (such as browser web storage or application data caches), databases, and server logs. These technologies help us track usage and remember your preferences.

We use Google Analytics 4 to help us understand how visitors use the Service. Information collected by the Google Analytics cookie or tracking tag is transmitted to, and stored by, Google in accordance with its privacy practices. You can opt out of Google Analytics by installing the Google Analytics opt-out browser add-on at tools.google.com/dlpage/gaoptout. We also collect some statistical information about visitors (for example, the number of visitors, pages viewed, and time online). This is not personal information, because we may not know who the visitor is, or because we aggregate it so that no person can be identified.

Our Service may contain links to other websites, and you may cite recipes located on other websites. We are not responsible for the privacy practices or the content of other websites, which may differ substantially from ours. Please read the privacy policy of any website you visit before using it.

We do not alter our website's data collection and use practices when we see a "Do Not Track" signal from your browser.

Tracking technologies and cookies

We may use beacons, tags, and scripts to collect and track information and to improve and analyze the Service. The technologies we use may include:

• Cookies or browser cookies. You can instruct your browser to refuse all cookies or to indicate when a cookie is being sent. However, if you do not accept cookies, you may not be able to use some parts of the Service.
• Web beacons. Certain sections of the Service and our emails may contain small electronic files known as web beacons (also called clear gifs, pixel tags, and single-pixel gifs) that permit us to count users who have visited those pages or opened an email, and for other related statistics.

Cookies can be persistent or session cookies. Persistent cookies remain on your device when you go offline, while session cookies are deleted as soon as you close your web browser. We may use persistent tracking and performance cookies (which may be administered by third parties) to understand traffic to our website, how users use it, and to test new pages, features, or functionality.

Sensitive information

Sensitive information includes information about your health, racial or ethnic origin, religious beliefs, and criminal record. Usually, we do not collect sensitive information. If we need to do so, we will only collect it with your consent and where it is reasonably necessary, or where we are otherwise allowed or required by law. If you provide us with sensitive information (for example, dietary or nutritional information you choose to enter), we will consider that you have consented to us collecting it.

Use of personal information

We may use and disclose your personal information to:

• provide our products and services to you;
• identify you and assist you to obtain and use our products and services;
• administer and manage our products and services;
• contact you by email, telephone, SMS, or push notification regarding updates, security updates, or informative communications related to the Service;
• respond to inquiries and provide customer support;
• provide you with information about the Service and how to use it;
• monitor and detect possible fraud or breaches of our terms;
• ensure the Service is used in a legal and responsible manner and that your account complies with relevant laws and your obligations to us;
• improve our products and services, and carry out planning, forecasting, and research;
• maintain the security and proper functioning of the Service;
• comply with our legal obligations, assist in the enforcement of laws, resolve disputes, and enforce agreements;
• administer surveys, contests, or other promotional activities;
• provide better, more personalized products and services tailored to your requirements;
• maintain and update our records;
• as otherwise required or authorized by law, or as authorized by you.

We may also use your information for purposes such as data analysis, identifying usage and food trends, building a profile of your preferences, making suggestions about recipes and products we think will match your preferences, marketing the Service, determining the effectiveness of our promotional campaigns, and evaluating and improving the Service and your experience.

Advertising and analytics. We do not conduct targeted (cross-context behavioral) advertising, and we do not build advertising profiles about you. We use Google Analytics 4 to understand how the Service is used, and Google Ads to measure the effectiveness of our own marketing campaigns. Where we share data with Google for analytics or campaign measurement, identifiers such as email addresses are hashed before they are transmitted, so they do not directly identify you.

We do not sell your personal information, and we do not share it for cross-context behavioral advertising. We may de-identify or aggregate information so that it can no longer be related to a specific individual, and may then use and disclose that information in the course of our business.

Disclosure of personal information

We may share your personal information in the following situations:

• with our service providers, to operate, monitor, and analyze the use of the Service, and to contact you;
• to and between our affiliates, who are also covered by this Privacy Policy;
• with our business partners, to offer you certain products, services, or promotions;
• when you share personal information or otherwise interact in public areas with other users, such information may be viewed and distributed outside the Service;
• to government agencies, regulators, and law enforcement bodies;
• to a court or tribunal, or to a person who serves us with a subpoena or other legal document;
• to our consultants, contractors, subcontractors, suppliers, service providers, and professional advisors who assist us in operating our business;
• to anyone who acquires, or considers acquiring, our assets or business (or part of it);
• with your consent, for any other purpose.

Location and international transfers

We conduct our business in the United States, and our service providers process information in the United States.

By using the Service or providing us with your personal information, you consent to the storage and use of your personal information in the United States, where the privacy or data-protection regime may differ from that of the country in which you reside. If we change the locations of the servers we use, we will update this Privacy Policy.

We take steps reasonably necessary to ensure that your personal information is treated securely and in accordance with this Privacy Policy, and that no transfer takes place to an organization or country unless there are adequate controls in place, including the security of your personal information.

Security and storage

We may store customer information (including personal information) in a variety of formats, including electronic and paper formats. Transmissions to or from the Service may be routinely monitored for quality control and systems administration. We take reasonable steps to ensure that your personal information is stored securely.

Security is a shared responsibility. If you use the Service, we encourage you to:

• use up-to-date operating system and browser software;
• scan downloaded documents for viruses and malware;
• avoid executing code or opening file formats you don't understand, and disable document macros when opening files from the Internet;
• use a complex, unique password that you don't use anywhere else, and never disclose it to others;
• keep your account to yourself — each user should have their own account;
• contact us immediately if you notice any unusual activity related to your account.

Although we take care, we cannot guarantee the security of information provided to us or stored electronically. No security measures are perfect, and we cannot guarantee the total security of any data transmission over the Internet. Personal information is only retained for as long as is necessary or as required by law.

Detailed information on processing

The service providers we use may have access to your personal information. These third-party service providers may collect, store, use, process, and transfer information about your activity on the Service in accordance with their own privacy policies. Our service providers may change, and we may be delayed in updating this list. Please contact us at admin@vizionality.com if you wish to confirm current information. Our service providers are Anthropic (AI processing to generate recipes), Google Analytics 4 (usage analytics), and Google Ads (measuring our own marketing campaigns). Aside from the AI processing of content you submit (described above), our service providers receive usage and analytics information used to improve the experience and to measure our campaigns; where we share data with Google, identifiers such as email addresses are hashed and do not directly identify you.

Analytics

We use Google Analytics 4, a web analytics service provided by Google, to monitor and analyze the use of the Service. Google may use the collected data in accordance with its privacy policy. You can opt out of Google Analytics by installing the Google Analytics opt-out browser add-on at tools.google.com/dlpage/gaoptout. For more on how Google uses data, see policies.google.com/privacy.

Advertising

We use Google Ads to promote KitchenKreate and to measure the effectiveness of our own marketing campaigns. We do not use it to serve you targeted behavioral advertising within the Service. Where we provide data to Google for conversion measurement, identifiers such as email addresses are hashed before transmission so they do not directly identify you.

Email marketing

We may use your personal information to contact you with newsletters, marketing or promotional materials, and other information that may interest you. You may opt out of receiving any or all of these communications by following the unsubscribe link in any email we send, or by contacting us.

Payments

KitchenKreate is currently free to download and use, and we do not collect payment information. If we introduce paid features in the future, we will update this Privacy Policy to describe how payments are handled and will not store your full payment card details ourselves.

Minors

KitchenKreate is a general-audience app rated 4+ on the App Store. We do not knowingly collect personally identifiable information from children under the age of 13. If you are a parent or guardian and you are aware that your child under 13 has provided us with personal data, please contact us at admin@vizionality.com, and we will take appropriate steps to delete it.

Access to and correction of personal information

You have the right to access, update, and correct the personal information that we hold about you. To access it, email admin@vizionality.com. We will provide a copy within a reasonable period, usually within 30 days. In some cases we may charge a reasonable fee to provide access (never to make a request), and we will advise you before doing so. Sometimes we may not be able to provide access to all of your personal information, and where this is the case we will tell you why. We may need to verify your identity when you make a request.

We take reasonable steps to ensure the personal information we hold is accurate, complete, up-to-date, relevant, and not misleading. To request an update or correction, email admin@vizionality.com. If we decline access or a correction, we will provide a written explanation (unless unreasonable to do so) and information about how to complain.

Deletion

For information stored in the Service, the Service includes functionality to allow you to download and delete the information in your account at no charge. You can delete your account and its associated data in the App at Settings › Account › Delete Account. You cannot (and we will not) delete information stored in another user's account.

For information held by us but not stored in the Service, if you ask us to delete your personal information from our records, we will do so within a reasonable time and take reasonable steps to ensure it is not used afterward (except as may be required by law). Your information may still be retained to resolve potential or actual disputes, enforce our agreements, or meet technical and legal requirements related to the security, integrity, and operation of the Service.

Specific jurisdictional provisions

European and UK residents

If you are a European or UK resident, you have the right to access the personal information we hold about you and to ask that it be corrected, updated, or deleted. We process your personal information to fulfill contracts we may have with you, or otherwise to pursue our legitimate business interests described above. Your information may be transferred outside of Europe, including to the United States. We may process your personal information under the following conditions: consent; performance of a contract; compliance with legal obligations; protection of vital interests; tasks carried out in the public interest; and our legitimate interests.

Under the GDPR, you have the right to:

• Access your personal information, and to update or delete the information we hold about you;
• Correct any incomplete or inaccurate information we hold about you;
• Object to our processing where we rely on a legitimate interest;
• Request erasure of your personal information where there is no good reason for us to continue processing it;
• Request transfer of your personal information in a structured, commonly used, machine-readable format (where processing is based on consent or a contract);
• Withdraw consent at any time (which may affect access to certain functionality).

California residents

This notice is provided under California law, including the California Consumer Privacy Act ("CCPA"). It supplements our Privacy Policy by explaining your privacy rights as a California resident.

• Right to access — you may request, up to twice each year, the categories and specific pieces of personal information we collect, use, disclose, and share about you;
• Right to correct — you may request that we correct inaccurate personal information we hold about you;
• Right to delete — you may request that we delete personal information we collect from you, subject to legal exceptions;
• Right to opt out — you may opt out of the "sale" or "sharing" of your personal information. We do not sell your personal information, and we do not share it for cross-context behavioral (targeted) advertising.

Virginia residents

Virginia law provides Virginia residents with the following rights:

• Access — confirm whether we are processing your personal data and access it;
• Correct — correct inaccuracies in your personal data;
• Delete — delete personal data provided by or obtained about you;
• Portability — obtain a portable copy of the personal data you provided;
• Opt out — opt out of targeted advertising, the sale of personal data, and certain profiling. We do not sell your personal data or process it for targeted advertising as defined under Virginia law.

Other US state residents

Depending on your state of residence, other US state privacy laws — including those of Colorado, Connecticut, and Texas — may give you rights similar to those above, such as the right to access, correct, delete, and obtain a portable copy of your personal data, and the right to opt out of targeted advertising, of any "sale" of your personal data, and of certain profiling. We do not sell your personal data, and we do not process it for targeted advertising. To exercise any of these rights, contact us at admin@vizionality.com. We may need to verify your identity before completing your request, and where a law provides an appeal process, we will honor it.

General

Other agreements that govern your use of the Service

In addition to this Privacy Policy, your use of the Service is governed by our Terms of Use. Please review them carefully.

Business transfers

We reserve the right to transfer information (including personal information) that you provide, or that we otherwise collect, in connection with a sale or transfer of assets or of any portion of our business.

Links to and from other sites

Our Service may contain links to other websites, and third-party websites may link to ours without our knowledge or control. We are not responsible for the privacy practices or content of those websites, which may differ substantially from ours, and we advise you to read their privacy policies before using them.
